We understand that Your privacy is important. We have updated our Privacy Policy which is effective from 16th October 2025. This Privacy Policy (“Policy”) aims to give You information on how Unext Learning Private Limited hereinafter referred to as (“We” or “Unext”) collects, uses, shares, processes, and protects the digital personal information, including the information shared on our websites, sub-domains, apps, and social media (the “Site(s)”), and information gathered from our referral partners. This Policy does not apply to physical records provided to us through postal or courier means.

This Policy is published in accordance with Rule 3(1) of the provisions of Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Intermediary Rules”) read with the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (“SPDI Rules”) and Digital Personal Data Protection Act, 2023 (“DPDP Act”).

This Policy is incorporated into our Terms and Conditions, and we encourage You to review this Policy before disclosing any personal information or sensitive personal information.

1. Notice and Definitions

This Policy is to inform You (“you/your/learner/user/end-user”) of the procedures regarding how we collect, use, share, retain, and protect Your digital personal data. Unext is committed to maintaining high confidentiality standards in accordance with requirements of the Information Technology Act, 2000 (as amended) and the Information Technology (Reasonable Security Practices and Procedures, Sensitive Personal Data or Information) Rules, 2011 and Digital Personal Data Protection Act, 2023 (collectively “The Act”). You understand that the Policy is governed exclusively by the laws of India.

1.1. Personal Data (PD)

Personal Data means any data about an individual who is identifiable by or in relation to such data.  PD may include any information that can be used to identify You, such as Your name, age, gender, date of birth, mailing address, company name, designation, email address, and contact number.

1.2. Sensitive Personal Data or Information (SPDI)

SPDI includes Your financial information bank account details, payment instrument details, passwords, health conditions, biometric information, and any government-issued identification documents.

2. Information We Collect

We collect information directly from You and Your employer, indirectly from third parties, and automatically through Your use of the Site and services offered by Unext.

2.1. Personal Data (PD)

  • Contact Data: Full name, residential address, telephone number, email ID, and alternate contact details.
  • Demographic Data: Age, gender, citizenship, and geographic location (state/city) for program eligibility checks.
  • Educational and Professional Data: Education history, marks, graduation year, employment history, resume/CV, and desired career track, company name, designation and official email ID.
  • Device Identity Data and Internet/Other Electronic Network Activity Information. Data such as your IP address, internet service provider, the type of mobile device you use, and identifiers associated with browser cookies. We and our third-party partners may also collect information about the devices and computers You use to access our Site, such as browser type, language, operating system, the referring web page, pages visited, and hyperlinks clicked. When You use our Site, We may collect usage information sent to us by your computer, mobile, or other access device that tells us how you are using the Site and other information about your internet activity (“Usage Information”), including the pages You visit, the links you click, the ads you view and click on, videos you watch, purchase information and your checkout process, your location when you access or interact with our Site, and other similar actions. We may also use third-party tools to collect Usage Information You provide to us or information about how You use the Site and may record your mouse movements, scrolling, clicks and keystroke activity and other browsing, search or purchasing behaviour.

2.2. Sensitive Personal Data or Information (SPDI)

  • Financial Details: Information required for processing payments, current organization CTC and payslips.
  • Identity Documents: Government-issued identification (e.g., PAN Card, Aadhaar Card, Passport) for KYC and Client-mandated verification.

Biometric/Media Data: Photographs, video recordings, and, where strictly required for identity verification, biometric data collected during assessments.

2.3. Program and Performance Data

  • Assessment Scores: Performance data from entrance exams, interviews, quizzes, module assignments, and final evaluations.
  • Usage Data: Logs, login history, IP addresses, browsing behaviour, time spent on the Learning Management System (LMS), and communication records (email, WhatsApp, SMS, Call Recordings).
  • Organization Data: Data provided by Your company or organization for service delivery requirements.
  • Promotional Media: Photographs and video footage captured during the program or at campus events for promotional purposes, used in accordance with the terms of the agreements executed with Your company.

2.4 Cookies and other technologies

Cookies are small files which are stored on Your device (unless You block them). They are designed to hold a modest amount of data specific to a particular visitor and website and can be accessed either by the web server or the visitor’s device. Our Site may use cookies and other technologies such as pixel tag and web beacons to identify You. We use third party cookies to understand and save Your preferences for future visits and compile aggregate data about site traffic and site interaction, tell us which parts of our Site visitors have visited, so that We can facilitate better Site experiences and tools in the future and measure the effectiveness of advertisement and web searches. You may disable cookies through Your individual web browser options. We treat information collected by cookies and other technologies as non-personal information. However, to the extent Internet Protocol (IP) addresses or similar identifiers are considered personal information by local laws, We also treat these identifiers as Personal Information, for the purposes of this Privacy Policy.   • To ascertain your organization’s training needs for tailoring program services, as per the requirements.

3.2. Program Completion and Issuance of Certificates (CRITICAL PURPOSE)

  • To share Personal Data (PD) and Sensitive Personal Data (SPDI), including Your assessment results, interview performance, and identity documents, with the Partner Organization/Client. This is mandatory for the Client to verify Your eligibility, schedule interviews, and process the Offer Letter (OL).
  • To assess participation eligibility and issue certificates of completion.

3.3. Marketing and Promotions

  • To communicate program updates, offers, and promote related programs.
  • To use Your photographs, video recordings, and testimonials (collected as part of Your Program Data) in promotional, marketing, and advertising material, as authorized by Terms and Conditions and respective agreements with Your organization.

3.4. Legal and Compliance

  • To comply with all applicable laws and regulations in India.
  • To respond to court orders, legal processes, and mandatory disclosures required by government authorities.

3.5. Recruitment and Career Opportunities

  • To evaluate and process applications for selection of candidates who express interest in working with Unext.
  • To retain/store candidate information to notify candidates about future career opportunities.

4. Disclosure and Sharing of Your Information

We do not sell or trade Your Personal Data (PD). We share it only with the following parties and strictly for the purposes outlined in Clause 3 of this Policy:

4.1. Partner Organizations (Clients)

We disclose Your information to our partner organizations/clients with whom You are seeking a job placement through the Program. This sharing is essential to the nature of the Job-Assured Programs and includes the sharing of performance data, background verification details, and profile information for placements and career opportunities

4.2. Group Entities and Affiliates

We share Your data with the Unext’s affiliates, group companies, and sister concerns strictly for internal business, operational, and administrative purposes, as they may assist in the delivery of services.

4.3. Third-Party Service Providers

We engage third parties to perform functions on our behalf, such as assessment providers, interview providers, Learning Management Systems (LMS), payment processors, cloud service providers (AWS, Azure, Google Cloud), testing platforms, background verification agencies, and email/Customer Relationship Management (CRM) services. These third parties are contractually obligated to maintain confidentiality and use Your data only for the provision of services to us.

4.4. Legal Authorities

We will disclose Your information when required by law, in response to valid requests by public authorities, or to protect the rights, property, or safety of Unext, our users, or others.

5. Security and Storage

5.1. Data Security

We employ industry-standard physical, electronic, and procedural safeguards to protect Your Personal Data and Sensitive Personal Data or Information. However, no data transmission over the internet or storage system can be guaranteed to be 100% secure. You acknowledge and accept this inherent security risk. You also have an important role in protecting your information; You should not share any username, password, or other authentication data provided to You with anyone.

5.2. Data Storage Location

Your Personal Data, whether in digital or hard copy, is primarily held and processed locally in India. Our digital assets are hosted on servers and applications provided by third-party cloud service providers, including but not limited to AWS, Microsoft Azure, or Google Cloud.

5.3 Data Retention

We retain your Personal Data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. The retention period may vary depending on the type of data and the legal or operational obligations involved. Once your data is no longer needed, We will securely delete, anonymise, or otherwise dispose of it in accordance with our data retention policies. You may request the deletion of your data at any time, subject to applicable legal requirements or legitimate business purposes that may necessitate its retention.

6. Your Rights and Access

You have the right to review the Personal Data You have provided to us and ensure that any Sensitive Personal Data or Information collected is accurate. You can request access, correction, or deletion of Your data, subject to our legal and contractual obligations to retain records for compliance and reporting to Clients.

7. Consent

Your consent is paramount, and you may choose to grant or decline Your consent for processing Your Personal Data. Your consent shall be collected when we obtain Your Personal Data or Sensitive Personal Data in accordance with the Act. The consent shall be collected through a pop up which asks for Your acceptance to the use of Personal Information and Sensitive Personal Information. The pop up shall appear on the respective pages on the Site, where such information is collected. You have the option to withdraw the consent given earlier, provided it is sent to us in writing to our support email id-  data.privacy@u-next.com from Your registered email ID. Please note that, if You choose to decline Your consent for processing of Your Personal Information, We may restrict your access of the Site and the Services offered by Us, at our discretion.

8. Children’s Privacy

The Site is not intended for individuals under the age of 18. No one under the age of 18 is authorized to provide any personal information through this Site. If you believe we might have any information from or about a child under 18, please contact us at the email ID provided below.
